We are a marketplace platform that connects mortgage borrowers ("Buyers"), licensed mortgage brokers ("Brokers"), and real estate agents ("Realtors"). We are not a lender, mortgage broker, or originator of loans.

1. Information We Collect

Information You Provide Directly

When you use our Services, we may collect:

  • Account information: Name, email address, phone number, password
  • Loan profile information: Loan amount, property type, property location (state/county), credit score range, down payment amount and source, employment status, income range
  • Identity verification: Date of birth, last four digits of Social Security Number (for soft credit verification only)
  • Payment information: Credit/debit card details processed by our payment processor (we do not store full card numbers)
  • Broker information: NMLS license number, business address, state licensing details, professional certifications
  • Realtor information: Real estate license details, brokerage affiliation
  • Communications: Messages you send through our platform or to our support team

Information Collected Automatically

When you visit our website or use our Services, we automatically collect:

  • Device information: IP address, browser type, operating system, device identifiers
  • Usage data: Pages visited, time spent, links clicked, referring URLs

Information from Third Parties

  • Credit bureaus: Soft credit pull data for credit range verification (no impact on credit score)

2. How We Use Your Information

We use the information we collect to:

  • Operate the auction platform and match Buyer profiles with eligible Brokers
  • Verify the identity and credentials of users, including Brokers' licensing status
  • Process payments and refunds
  • Communicate with you about your account, auctions, and Services
  • Send transactional emails (auction status, bid notifications, account changes)
  • Send marketing emails to users who have opted in (you can opt out anytime)
  • Detect, prevent, and respond to fraud, sabotage, and platform abuse
  • Comply with legal obligations, including financial regulations
  • Improve our Services and develop new features
  • Generate aggregated, anonymized statistics about platform performance

3. How We Share Your Information

With Brokers Participating in Your Auction

When you submit a loan profile, we share anonymized loan profile information with Brokers who meet your matching criteria. Brokers do not see your name, contact information, or identifying details until you accept their bid.

Once you accept a bid, we share your full contact information and loan profile details with the selected Broker only — never with the brokers whose bids you did not accept.

With Realtors Who Refer You

If you signed up via a Realtor referral link, we may share aggregated outcome data (whether you completed an auction, accepted a bid) with the referring Realtor. We do not share your loan details, identity, or financial information with Realtors.

With Service Providers

We share information with third-party service providers who help us operate the Services, including:

  • Payment processors (Stripe or equivalent)
  • Email service providers (SendGrid)
  • Email verification services (NeverBounce)
  • Credit verification services
  • Cloud hosting and database providers
  • Customer support tools
  • Analytics providers

All service providers are contractually obligated to protect your information and use it only for the services they provide to us.

For Legal Reasons

We may disclose your information when required by law, regulation, court order, or other governmental request, including responses to subpoenas, requests from law enforcement, or to protect the rights, property, or safety of MortgageNegotiator, our users, or others.

Business Transfers

If MortgageNegotiator is involved in a merger, acquisition, sale of assets, or bankruptcy, your information may be transferred as part of that transaction. We will notify you of any such change.

4. Financial Information and GLBA Notice

The Gramm-Leach-Bliley Act ("GLBA") governs the use of nonpublic personal financial information by financial institutions and certain financial services providers. Because we collect financial information in the course of connecting Buyers with Brokers, we provide the following notice:

5. Your Choices and Rights

Access, Correction, and Deletion

You can: - Access and update your account information by logging in - Request a copy of the personal information we hold about you - Request deletion of your account and associated information - Object to certain uses of your information

Marketing Communications

You can opt out of marketing emails at any time by clicking the "unsubscribe" link in any marketing email. Transactional emails (auction status, payment confirmations, account changes) cannot be opted out of while you have an active account.

You can control cookies through your browser settings. See our Cookie Notice below for details. Disabling cookies may affect the functionality of the Services.

Do Not Track

We do not currently respond to "Do Not Track" browser signals because no industry standard has been finalized.

6. California, Florida, and Other State Residents

Florida Information Protection Act

Florida residents have rights under the Florida Information Protection Act ("FIPA"), including the right to be notified of certain data breaches affecting their personal information. We will notify Florida residents in accordance with FIPA requirements if a covered breach occurs.

We do not sell personal information.

We retain your information for as long as your account is active and as needed to provide Services. After account closure, we may retain certain information:

  • To resolve disputes and enforce our agreements

  • For up to 7 years for financial transaction records, as required by applicable law

9. Children's Privacy

10. International Users

Our Services are intended for users in the United States, currently limited to Florida residents for mortgage transactions. If you access the Services from outside the U.S., your information will be transferred to and processed in the U.S.
